1. Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application under Section 528 BNSS has been filed with the prayer to setting aside the charge sheet and the entire proceedings of S.T. No.150 of 2014 arising out of Case Crime No.275 of 2012 under Sections 147, 148, 149, 332, 333, 336, 307 I.P.C. and under Section 152 of the Railways Act & 4/5 Explosive Substances Act & under Section 7 of the Criminal Law Amendment Act, Police Station- Bhadohi, District-Bhadohi pending in the Court of Sessions Judge, Bhaohi-Gyanpur. Further prayer has been made to stay the proceedings of the aforesaid case. 3. It is submitted by the learned counsel of the applicant that the FIR has been lodged on false grounds while the applicant has not committed any offence. The police has also submitted charge sheet on the basis of insufficient evidence against the applicant. Essential ingredients to constitute the alleged offences are lacking. The present prosecution has been instituted with malafide intention. It is further submitted that the applicant has been falsely implicated in this case and he has actually no concern with the alleged matter. It is also submitted that some witnesses have been recorded before the trial Court and they have averred nothing against the present accused applicant. On these grounds prayer for quashing the entire proceedings of this case has been made. 4. A.G.A. has opposed the prayer. 5. It appears from the perusal of the record that the case is running at the stage of evidence and about 5 prosecution witnesses have been examined so far. 6. In these circumstances, it would not be proper to make any comment Versus Counsel for Applicant(s) : Ashok Kumar Singh Counsel for Opposite Party(s) : G.A. appreciating the oral evidence on record because the trial is going on and also there is no justification to quash the charge sheet/ entire proceedings in this case, where it is a matured case before the trial Court. 7.
In view of this, no relief may be granted to the accused applicant in this case but however, the learned trial Court is directed to make all the endeavour for the expeditious disposal of this case. 8. The application is, accordingly, disposed of. October 29, 2025 Fhd NA528 No. 40194 of 2025 2 (Nalin Kumar Srivastava,J.) Digitally signed by :- FAHAD NIYAZ High Court of Judicature at Allahabad
