Neutral Citation No. - 2025:AHC:142500 Court No. - 83 Case :- CRIMINAL APPEAL No. - 1031 of 2025 Appellant :- Narendra Rajbhar And 7 Others Respondent :- State of U.P. and Another Counsel for Appellant :- Man Bahadur Singh Counsel for Respondent :- G.A.,Vinod Kumar Yadav Hon'ble Shekhar Kumar Yadav,J.
1. Heard Mr. Man Bahadur Singh, learned counsel for the applicants, learned AGA for the State, Mr. Vinod Kumar Yadav,
learned counsel for the respondent no.2 and perused the materials on record.
2. The present criminal appeal under Section 14-A(2) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred against the impugned order dated 21.11.2024 passed by Special Judge (SC/ST Act) Azamgarh in Special Case No.137 of 2022 (State of U.P. vs. Narendra and others), under Sections 452, 323, 504 IPC and Section 3(1) Da & 3(1) Dha SC/ST Act, Police Station Bilariyaganj, District Azamgarh whereby the discharge application of the appellants has been rejected.
3. I have heard learned counsel for the parties and gone through the impugned order. Impugned order itself reflects that charges against the accused have already been framed and the grounds taken for discharge cannot be considered at this stage as truthfulness, sufficiency and acceptability of the evidence produced by the accused can be adjudged during trial. The impugned order passed by the court below is well in conformity in law and does not suffer from error of illegality, irregularity and warrant any interference by this Court.
4. The application is without merit and is hereby dismissed.
5. At this stage, learned counsel for the applicants prays for early disposal of the trial.
6. In the circumstances, Trial Court is expected to conclude and decide the trial of Special Case No.137 of 2022 (State of U.P. vs. Narendra and others), under Sections 452, 323, 504 IPC and Section 3(1) Da & 3(1) Dha SC/ST Act, Police Station Bilariyaganj, District Azamgarh without granting any unnecessary adjournment to either of the side expeditiously fixing short dates.
