By the present writ petition, the petitioner is questioning the communication dated 30/01/2024 issued by the respondent No.3/ District Education Officer, Raigarh by which the representation preferred by the petitioner for correction of his date of birth in his service record has been rejected. 2. Learned counsel appearing for the petitioner would submit that the date of birth of the petitioner has been recorded in the service record as 13/06/1964, however, his correct date of birth is 13/06/1968 and with regard to the same, he submitted a representation but the DEO has rejected the same in an arbitrary and illegal manner. 3. Learned counsel appearing for the State would oppose the submission made by the petitioner and submit that the District Education Officer, after going through the ‘Dakhil Kharij’ issued by the Govt. Boys’ Primary School, Kirodimal Nagar, District Raigarh and the mark sheet of Class 8th and 11th issued by Board of Secondary Education, Bhopal, M.P. wherein the date of birth of the petitioner has been recorded as 13/06/1964, has rejected the representation submitted by the petitioner. Hence, there is no illegality in the impugned letter dated 30/01/2024 issued by the DEO. The DEO has rightly rejected the representation by relying upon the certificates issued by the Board of Secondary Education, 3 / 3 Bhopal, M.P. 4. I have heard learned counsel for the parties and perused the documents. 5. From perusal of the communication dated 30/01/2024, it appears that the DEO has rejected the representation of the petitioner whereby he was seeking correction of his date of birth in the service record. 6. It is not in dispute that in the mark sheet of Class 8th and 11th issued by Board of Secondary Education, Bhopal, M.P., the date of birth of the petitioner has been recorded as 13/06/1964 which was supported by the ‘Dakhil Kharij’ issued by the Govt. Boys’ Primary School, Kirodimal Nagar, District Raigarh. 7. Considering the facts and circumstances of the case, it is crystal clear that there is no illegality in the impugned letter dated 30/01/2024 (Annexure P/1) issued by the DEO, Raigarh whereby the representation submitted by the petitioner for correction of his date of birth in his service record, has been rejected. 8.
