Page No.# 2/2 The petitioner has approached this court after being aggrieved by an Order dated 10.07.2025 passed by the Court of learned Sessions Judge, Karbi Anglong, Diphu in NDPS Case no. 39/2025 whereby an application preferred by the petitioner seeking interim custody of a bus bearing Registration no. MH-07-H/0011 [‘the subject-vehicle’] has been rejected. The petitioner has claimed that he is the registered owner of the subject-vehicle. In the Order dated 10.07.2025, it is reflected that the charge-sheet in connection with Dillai Police Station Case no. 02/2025 has already been submitted. As the charge-sheet is not annexed with the instant petition, Ms. Banik, learned counsel for the petitioner has sought liberty to withdraw the petition to file afresh by bringing the charge- sheet on record. In view of the above submission made by Ms. Banik, learned counsel for the petitioner, the petition is allowed to be withdrawn with the liberty to the petitioner to file afresh.
