At the very outset, learned A.G.A. for the State has pointed out that in the instant appeal, appellant- Pradeep Tiwari @ Pande has already passed away on 08.05.2023. Chief Judicial Magistrate, Etawah vide his letter dated 31.07.2025 has informed this Court that appellant- Pradeep Tiwari @ Pande has already passed away. In verification of his death, statements of Rashmi Tiwari wife of appellant- Pradeep Tiwari @ Pande and Ankit Dubey son of Late Arvind Dubey have been recorded. Police Report of Sub-Inspector Jaswant Singh of Police Station Basrehar, District- Etawah has already been annexed. Death certificate issued by the Government of Uttar Pradesh has also been brought on record. 3. In view thereof, since the appellant- Pradeep Tiwari @ Pande has already passed away, the instant criminal appeal is dismissed as having been abated.
