Neutral Citation No. - 2025:AHC-LKO:2270-DB Court No. - 2 Case :- WRIT - C No. - 11433 of 2024 Petitioner :- Sudha Gond Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko And 4 Others Counsel for Petitioner :- Doodh Nath Mishra,Amit Kumar Mishra,Anand Kumar Bajpai Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State. The petitioner senior citizen has filed this writ petition against daughter-in-law and her brother who is opposite party no. 5. On being asked as to who is grabbing the house of the petitioner the petitioner's counsel submitted that it is the private opposite parties no. 4 and 5 who are grabbing the same. On being pointed out that the remedy would be under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and Rules, 2014 he submitted that he has already filed an application under the said Act. On being further asked as to how a writ petition is maintainable at this stage and why correct advice was not given to the petitioner the learned counsel had no explanation whatsoever. We are fed up with such frivolous petitions and those which are not maintainable. The writ petition is dismissed as not maintainable. . (Brij Raj Singh,J.) (Rajan Roy,J.)
