Learned counsel for the petitioner could not place before us any provision under which the penalty imposed by the Information Commission under the Right to Information Act, 2005 could be recovered by the District Magistrate, Lucknow, therefore, relief No.1, as prayed, cannot be granted. The order is to the Secretary, Lucknow Development Authority to deduct the amount from the salary of the concerned official, whereupon the same shall go to the State and not to the petitioner. The petitioner may pursue the matter before the authorities concerned if he has a locus and a cause. As regards, the relief No.2, the same is un-related to relief No.1, the petitioner may pursue the said grievance before the concerned authority. The petitioner is disposed of in the aforesaid terms.
