State of H.P and others vs. Harinder Singh and others CMP(M) No. 1120 of 2025 Item No.D-4 01.08.2025 Present: Mr. Anup Rattan, Advocate General with Mr.Rakesh Dhaulta, Additional Advocate General, for the applicants/appellants. CMP(M) No. 1120 of 2025 Inter alia contends that though the land owners had contended that the road was constructed in the year 2014-2015 from “Badoori to Jadli via Bokra”, the Specific stand of the State was that the construction had been done in the year 1994 on public demand and there is only up-gradation in the year 2014. Thus, it is submitted that the petition had suffered from delay and laches, which aspect has not been kept in mind by the learned Single Judge, as the benefit of interest as such would also accrue for all these long years and the land owners would be unduly enriched. A reference is made to the pendency of LPA No.337 of 2025. Keeping in view the averments made in the application, duly supported by an affidavit, the delay of 78 days’ in filing the Appeal is condoned. The application stands disposed of. LPA No. 496 of 2025 & CMP No.18578 of 2025 Notice be issued to the respondents, on steps being taken within two days, returnable for 11.08.2025. Dasti service is also permitted.
