Neutral Citation No. - 2025:AHC-LKO:1548 Court No. - 6 Case :- WRIT - A No. - 12907 of 2024 Petitioner :- Asha Singh Respondent :- State Of U.P. Thru. Addl. Prin. Secy. Bal Vikas Pushtahar Govt. Of India Lko. And 4 Others Counsel for Petitioner :- Anurudh Kumar Singh,Ram Briksh Yadav Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J. 1. Heard Sri Aniruddha Kumar Singh, learned counsel for the petitioner as well as learned Standing counsel for the respondents. 2. It has been submitted that the petitioner is working on the post of Anganwadi Sahayika at Anganwadi Kendra Nagla Lothu, Block Shahabad, District Hardoi. It has further been submitted that educational qualification of the petitioner is that she passed class 10th in 2007 and class 12th in 2010 and accordingly is duly qualified for being promoted to the post of Anganwadi Karyakartri. 3. The petitioner in the present writ petition has challenged the order whereby the appointment by direct recruitment has been sought to be made on the post of Anganwadi Karyakartri. One of the grounds raised by the petitioner is that the Anganwadi Kendra of the petitioner has not been included in the said advertisement and consequently the petitioner will not be able to participate in the said selection. 4. Learned Standing counsel, on the other hand, has opposed the writ petition. He submits that the claim, if any, of the petitioner would only be against promotional quota of 50 percent to which she is entitled and eligible. On the basis of written instructions received from District Programme Officer, Hardoi, he has informed that initially the case of the petitioner was not considered for promotion because she had not filed her educational qualification documents for the post of Anganwadi Karyakartri but subsequently she has uploaded the educational documents of class 10th and 12th which have been received by the respondents and now it has been stated that the respondents would proceed to consider the petitioner for promotion on the post of Anganwadi Karyakartri in accordance with the Government Order dated 21.3.2023. 5. In light of the statement made by learned Standing counsel and specially the fact that the petitioner would now be considered for promotion, learned counsel of the petitioner submits that the grievance of the petitioner stands redressed and does not want to further press the writ petition. 6. Accordingly, the petition is disposed of with a direction to the respondents to consider the case of the petitioner for promotion to the post of Anganwadi Karyakartri in accordance with law.
