Mr. Arsh Rattan, Learned Deputy Advocate General, accepts and waives service of notice on behalf of the respondents. 3. Petitioner, Sarita Devi, has come up before this Court, seeking following relief(s): “(i). That in view of the facts and circumstances mentioned hereinabove in this writ petition, the writ petition may kindly be allowed and impugned order dated 04.06.2025 may kindly be quashed and set-aside, being malafide and arbitrary.” 1 Whether reporters of Local Papers may be allowed to see the judgment? In the background of above prayer(s) Learned Counsel for petitioner submits that on the basis of orders dated 04.06.2025 [Annexure P-1] transferring the petitioner from GMS Bastla U/c GSSS Nabahi to GMS Khalai U/c GSSS Badsahal, District Shimla; the petitioner had submitted a representation to Deputy Director Elementary Education, Mandi dated 09.06.2025 [Annexure P-2], which is stated to be pending. 5. On query by this Court Learned Counsel for petitioner submits that the petitioner stands relieved from GMS Bastla U/c GSSS Nabahi and Ms. Kusum Lata [not impleaded as party respondent] has joined in her place also. Since, the petitioner stands relieved and substitute [Kusum Lata] has joined in place of petitioner therefore, prayer for staying the operation of the Impugned Transfer Orders dated 04.06.2025 [Annexure P-1] is not made out and is declined. 6. In peculiar facts of this case, Learned Counsel for the petitioner on instructions states that 2025:HHC:18152 - 3 - petitioner shall be satisfied, in case, Respondent No.2-Director, School Education, Himachal Pradesh is directed to consider/examine the representation dated 09.06.2025 [Annexure P-2]. At this stage, Learned Counsel for petitioner is permitted to make an additional representation, within two days from today, which shall also be considered/examined by the Competent Authority. 7. The prayer made by Learned Counsel for the petitioner, being innocuous is not opposed by Learned State Counsel also. 8. Leaving all questions open and in view of the request of Learned Counsel for the petitioner, this Court disposes of the instant petition, at this stage, in the following term(s): (i). State Authorities, including Respondent No.2-Director, Department of School Education, Himachal Pradesh is directed to consider/examine the representation dated 09.06.2025 [Annexure P-2] and additional representation if submitted, in accordance with Transfer Policy and the law; after hearing the petitioner and substitute- Kusum Lata [not impleaded] on or before 2025:HHC:18152 - 4 - 23.06.2025; (ii). However, it is clarified, that till the decision of the representation, Respondents shall not compel the petitioner to join the transferred station and petitioner is free to avail leave of kind due. (iii). No order as to costs. In aforesaid terms, the instant writ petition and all pending miscellaneous application(s), if any, shall also stand disposed of.
