Ms. Smriti Gupta, learned counsel holding brief of Shri Ramesh Kumar Shukla, learned counsel for the respondents contends that the petitioner has an alternative remedy of assailing the impugned order dated 10.05.2024 before the competent authority under the service rules. Faced with this, Shri Harsh Vardhan Gupta does not press the reliefs sought in the writ petition. He recasts the reliefs. He fairly submits that the appeal has already been pending before the respondent No.2. However, the same has not been decided till date. The only prayer made by the learned counsel for the petitioner is that the appeal of the petitioner be decided within a stipulated period of time. In the wake of the preceding submissions, the matter is remitted to the respondent No.2-Chairman Aryavrat Bank, Gomiti Nagar, Lucknow to execute the following directions: I. The respondent No.2-Chairman Aryavrat Bank, Gomiti Nagar, Lucknow shall decide the appeal of the petitioner against the impugned order dated 10.05.2024 within a period of three months from the date of receipt of a certified copy of this order along with a fresh memo of appeal. II. The appeal of the petitioner shall be decided by the respondent No.2 on merits without going into the issue of delay. With the aforesaid directions, the writ petition is finally disposed of.
