JUSTICE MICHAEL ZOTHANKHUMA ORDER 19.03.2025 Heard Mr. N.K. Sarma, learned counsel for the writ petitioner. Also heard Mr. D. Gogoi, learned Standing Counsel, Assam Agricultural University. 2. Pursuant to an Advertisement No.8/2023 dated 11.12.2023, issued by the Registrar, Assam Agricultural University, Jorhat, (AAU) the petitioner applied for the post of Assistant Professor in the Discipline of Veterinary Surgery & Radiology. After submitting her application, the respondents issued an Acknowledgement letter dated 13.01.2024 acknowledging the receipt of her application. Thereafter, the Registrar, AAU issued a Notification dated 09.08.2024 declaring the names of the eligible candidates in pursuant to the report of the Screening Committee. In the said Notification, the name of the petitioner was not found with regard to the post of Assistant Professor in the Discipline of Veterinary Surgery & Radiology. Being aggrieved, the petitioner submitted an e-mail on 13.08.2024, contending that she fulfills all the eligibility criteria mentioned in the Advertisement dated 11.12.2023. Thereafter, the Registrar, Assam Agricultural University, Jorhat by a communication dated 13.08.2024 informed the petitioner that her application for the post of Assistant Professor in the Discipline of Veterinary Surgery & Radiology against Page No.# 3/4 Advertisement No.8/2023 was rejected, as the total API (Academic Performance Indicator) mark was below the qualifying score as reported by the Screening Committee. It is the case of the petitioner that in the essential qualifications required for the post of Assistant professor in the Advertisement dated 11.12.2023, there is no condition with regard to consideration of the Academic Performance Indicator (API). Being aggrieved with the rejection of her application, the petitioner is before this Court by way of the present writ petition. 3. This Court, vide the interim order dated 21.08.2024, directed the respondents to permit the petitioner to appear in the interview for the post of Assistant Professor in the discipline of Veterinary Surgery & Radiology, pursuant to the Advertisement No.8/2023 dated 11.12.2023. This Court also directed the respondents not to finalize the selection process till the next returnable date. 4. The petitioner thereafter appeared in the selection process pursuant to the interim order passed by this Court. In pursuance to the order dated 19.03.2025 passed in I.A. (Civil) No.568/2025, the Assam Agricultural University/respondent Nos.1 & 2 has been allowed to declare the results of the selection process, including the result obtained by the petitioner. As the results have to be declared by the respondent Nos.1 & 2, this Court has opened the envelope containing the marks of the candidates. The selection process result shows that the petitioner has not been selected, as she has secured lesser marks than the other candidates for the said post. Due to the above reason, this Court is not going into the issue as to whether the petitioner could have been barred from participating in the selection process, as the same would now only be of academic interest. However, if and when such situation arises in the future, the petitioner is given the liberty to agitate the said issue again. Page No.# 4/4 5. The writ petition is accordingly disposed of.
