2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 323/341/353/504/506/342/147/149 of IPC.
3. The learned APP opposes the prayer for anticipatory bail.
4. There is allegation against the petitioner and others that they obstructed the police from performing his duty and with a bomb, they had got released the tractor which was seized by the police official as they were indulged in illegal mining of chips and sands.
5. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
6. Thus, I am not inclined to entertain the anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Mirzachowki P.S. Case No.96 of 2023, pending in the Court of learned Sub-Divisional Judicial Magistrate, Sahibganj, stands rejected.
7. Petitioner should appear before the Court concerned where their case will be especially considered taking into consideration the status of other co-accused.
