This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Sections 147, 148, 149, 341, 323, 467, 468, 471, 420, 504, 506 of the Indian Penal Code. 3. It is alleged in the FIR that the informant’s mother-in-law vide certificate case had purchased a chunk of land in the year 1925-26. It is further alleged that after the mother-in-law, this informant and others were occupying the same peacefully but the petitioners forcefully on the basis of the some forged documents are selling their property. It is alleged that when the informant protested he was also assaulted. 2025:JHHC:18865 2
4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. After hearing the parties and after going through the records, I find that the petitioners are also claiming the said land by virtue of some deed of 1926. A suit is also pending, which is filed by the petitioners, being Original Suit No. 70 of 2019 in which Kavita Banerjee who is the informant is the first defendant. 6.
Considering the aforesaid fact, since the primary dispute is in respect of right, title, interest and possession over the landed property in question, this Court finds it a fit case for grant of anticipatory bail to the petitioners as custodial interrogation is not required. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Civil Judge (Sr. Div.) II cum JM 1st Class, Bokaro, in connection with Chas (M) P.S. Case No.41 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
