The instant application has been filed by the applicants seeking following main relief:- "For the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the criminal proceeding of Criminal Case No. 2456 of 2024, under Section- 126/135 of BNSS 2023, Police Station-Rudauli, District-Ayodhya, State of U.P. Versus Jabbar Ali and others arising out of chalani report dated 26.11.2024 pending in the court of Sub Divisional Magistrate Rudauli, District-Ayodhya and further it may be pleased to stay the criminal proceeding of Criminal Case No. 2456 of 2024, under Section-126/135 of BNSS 2023, Police Station-Rudauli, District-Ayodhya, State of U.P. Versus Jabbar Ali and others arising out of chalani report dated 26.11.2024 pending in the court of Sub Divisional Magistrate Rudauli, District- Ayodhyain, the interest of justice." On being confronted after taking note of the fact that the report submitted by the police officer has been challenged in this application, learned counsel for the applicants says that he may be permitted to withdraw the present application with liberty to the applicants to challenge the proceedings, in issue, after issuance of notice by the Magistrate concerned, if required. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for.
