Neutral Citation No. - 2025:AHC-LKO:502 Court No. - 5 Case :- WRIT - A No. - 12853 of 2024 Petitioner :- Dr. Om Prakash Singh And Another Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Finance U.P. Lko. And 3 Others Counsel for Petitioner :- Manoj Kumar Mishra,Piyush Tripathi,Sampurnanand Dwivedi,Shubham Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Abdul Moin,J. Heard learned counsel for the petitioners and Sri Vivek Shukla, learned Additional Chief Standing Counsel appearing for the respondents. With the consent of learned counsel for the parties, the writ petition is being finally disposed off. The contention of learned counsel for the petitioners is that despite an order dated 13.03.2009, a copy of which is Annexure-1 to the petition, having been issued by the Ministry of Agriculture Research and Education, New Delhi in respect of payment of gratuity and leave encashment as well as an order dated 21.09.2010 issued by the Principal Secretary, Agriculture, U.P. regarding revision of pay scale yet neither the said pay scale has been revised nor the correct gratuity and leave encashment has been paid to the petitioners till date. Learned counsel for the petitioners after arguing at some length submits that in this regard the petitioners have already submitted a representation dated 01.12.2024, a copy of which is Annexure-14 to the petition, before respondents no.1 and 2 which is still pending for consideration which may be directed to be decided within a fixed time frame to which learned Additional Chief Standing Counsel has no objection. In view of the above, it is provided that respondent No.2 shall consider and decide the representation of the petitioners dated 01.12.2024 (Annexure-14 to the writ petition) by means of a reasoned and speaking order within a period of six weeks from the date of receipt of a certified copy of this order. With the aforesaid direction, writ petition is disposed off. It is made clear that this Court has not gone into the merits of the case. Order Date :- 3.1.2025 A.
