JUSTICE SANJEEV KUMAR SHARMA ORDER 26.08.2025 1. Heard Mr. S. Munir, learned counsel appearing for the accused petitioner as well as Ms. N. Kakati, learned standing counsel DRI. 2. By this petition under Section 483 BNSS, the accused-petitioner, namely (1) Mohd Arif (2) Mohd Nadeem and (3) Mohd Nabi, has prayed for grant of bail in connection with DRI Case No. 09/CL/IMP/CIG/DRI/GZU/2025-26 under Section 135 of the Customs Act, 1962. 3. Learned counsel appearing for the DRI prays for some more time to produce the case diary. 4. On perusal of the order sheet it reflects that already two chances have been granted to the DRI to provide the case diary and in the meantime, the accused person has been in custody since 13.07.2025. Hence, this Court is not inclined to grant further time. 5. FIR reveals the allegation that the accused persons were found transporting a large quantity of foreign cigarettes without proper documents etc. 6. Having regard to the nature of the allegations as well as the period of detention of about 45 days already undergone, further detention of the accused persons is not considered necessary. Hence, prayer for bail is allowed. 7. Accordingly, it is provided that the accused petitioners, named above, shall be released on bail of Rs.50,000/- each (Rupees Fifty Thousand) with two sureties Page No.# 3/3 of like amount to the satisfaction of learned Chief Judicial Magistrate, Kamrup(M) subject to the following conditions- i) That the accused petitioner shall continue to co-operate with the investigation; ii) That the accused petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Police Officer or the Court. 8.
