Order 28/07/2025
1. Two petitioners preferred this writ petition way back on 05.05.2012, raising an issue that respondents have engaged the petitioners as Pharmacist on contractual basis through placement agency whereas since petitioners possess the requisite eligibility, they should have been considered for grant of regular appointment under the Rajasthan Medical and Health Subordinate Service Rules, 1965 (for short “the Rules of 1965”).
[2025:RJ-JP:28265] (2 of 2) [CW-7428/2012]
2. According to the respondents, petitioners never applied pursuant to the vacancies notified by the Government under the Rules of 1965, hence, they can not claim for appointment on regular basis.
3.
Learned counsel for the petitioners submits that petitioners have not turned up in his office to pursue the writ petition on merits, after filing the same, and he pleads no instructions.
4. Taking into consideration the matter and issue, it appears that the relief prayed for by the petitioners in the instant writ petition has rendered infructuous with passage of time and apparently, for such reasons, petitioners have not turned up to pursue the writ petition on merits.
5. In that view of matter, the writ petition is dismissed. However, in case any fresh cause of action arise to petitioners, they are at liberty to seek the appropriate legal remedy.
6. Stay application and any other pending application, if any, also stand disposed of.
