The petitioner is seeking regular bail in connection with Rajrappa P.S. Case No.165 of 2024 corresponding to Special POCSO Case No.36 of 2024, for the offence registered under sections 65 of BNS, 2023 and Section 4&6 of POCSO Act, pending in the court of learned Sessions Judge, Ramgarh. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 19.10.2024 and the victim has been examined as PW-2 and she has not identified the petitioner and she has also denied about any action on the part of the petitioner. The evidence of the victim is annexed at page 19 of the petition. The mother who has been examined as PW-1 has also denied about the occurrence. 4. Learned counsel for the respondent State has opposed the prayer and submits that allegation of rape is there. 5. Considering that the Annexure-2 series is the statement of mother and the victim who has been examined as PW-2 and the mother who has been examined as PW-1 respectively have not supported the case of the prosecution case, I am inclined to grant regular bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of the learned Sessions Judge, Ramgarh in connection with Rajrappa P.S. Case No.165 of 2024 corresponding to Special POCSO Case No.36 of 2024. 7. This petition is disposed of. ( Sanjay Kumar Dwivedi, J.) SI/
