The applicant – Shofi Khan @ Sovi, who is in judicial custody in connection with FIR No. 183 of 2023, under Sections 307, 326, 504 and 506 of IPC and 4/ 25 of Arms Act, registered at P.S.- Gadarpur, District Udham Singh Nagar, has sought his release on bail. 4. In this case, an FIR was lodged by the complainant, who is brother of the victim, wherein, he has alleged that on 18.08.2023, around 05: 45 PM, when complainant’s brother was at his shop near S.S. Public School at Gadarpur, applicant came near to him and used abusive words and attacked on him with sharp knife due to which his head, eyes, face and other parts of the body got injured. 5. Heard learned counsel for the parties and perused the records. 6. Learned counsel for the applicant would submit that there is delay of eight hours in lodging of the FIR which creates doubt on the prosecution’s story; no knife was recovered from the applicant; and, applicant is languishing in jail since 18.08.2023. 7. Per contra, learned State Counsel vehemently opposed the bail application and would submit that the offence alleged is of a grave and heinous nature; as per the medical report, the injury is dangerous which is alleged to be caused by sharp- edged weapon. 8. Having considered the facts and circumstances of the case, this Court is of the view that there is no good ground to enlarge the applicant on bail and the present bail application deserves to be rejected. 9.
