The present application has been filed for the following main relief:- "Wherefore it is most respectfully prayed that this Hon'ble court may kindly be pleased to set aside/quash the Chargsheet No. 148 dated 22-06- 2019 as well as quashing the impugned summoning impugned order dated 11-09-2019 passed by First Upper Civil Judge (S.D.) Sitapur, arising out of Case Crime No. 217/19, State Vs Kamal Kishor Trivedi and others, U/s- 420, 406, 352, 506 I.P.C as well as the entire proceeding of the above noted case." After arguing at some length, the learned Counsel for the applicant states that he may be permitted to withdraw the present application with liberty to file a fresh with proper pleadings and documents in support thereof. To the aforesaid prayer, learned A.G.A. has no objection. Accordingly, the present application is dismissed with liberty as aforesaid.
