Admittedly against the order of termination dated 20.11.2024, a copy of which is annexure 13 to the writ petition, the petitioner has an alternative remedy of filing of appeal before the Secretary, U.P. Basic Education Board as per Rule 5 of the U.P. Basic Education Staff Rules, 1973 which fact has also been admitted by Shri Kumar Auysh, learned counsel for the respondent no. 2. Considering the aforesaid, the writ petition is disposed of with liberty to the petitioner to file an appeal before the competent authority within a period of two weeks from today. In case the said appeal is filed within two weeks then the appellate authority shall proceed to decide the aforesaid appeal in accordance with law and the relevant rules within a period of two months from the date of filing of appeal.
