Neutral Citation No. - 2025:AHC-LKO:1015-DB Court No. - 2 Case :- WRIT - C No. - 11196 of 2024 Petitioner :- Rajesh Kumar Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Lko. And 2 Others Counsel for Petitioner :- Mohammad Ehtesham Khan Counsel for Respondent :- C.S.C.,Namit Sharma Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. 1. Sri Savitravardhan Singh, Advocate has filed Vakaltanama on behalf of opposite party nos.2 and 3 which is taken on record. 2. Heard. 3. Petitioner alleges encroachment by Nagar Nigam on his land. The contention is that the petitioner purchased part of Gata no.1468 from some of its tenure holders vide sale deed dated 20.05.2015 but the officials of Nagar Nigam are creating hindrances in possession of the petitioner. We pointedly asked petitioner's counsel as to whether Nagar Nigam has encroached upon Gata no.1468, he submitted that they have not encroached on the said land but are interfering in the possession. 4. If it is so then an injunction can be sought from the concerned court in this regard. However, if there is encroachment then the petitioner can get the land demarcated whether it be under the U.P. Revenue Code, 2006 or otherwise. 5. We, therefore, dispose of this petition with these observations. (Brij Raj Singh,J.) (Rajan Roy,J.)
