2025:JHHC:17678 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3505 of 2025 Safiran Bibi, W/o Ibrahim Mian, R/o Village- Shakhabara, P.O.- Palunjia, P.S.- Birni, District- Giridih .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). …… CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Shree Nivas Roy, Advocate For the State : Ms. Shweta Singh, AddI. P.P. For the Informant : Mr. Arwind Kumar, Advocate …...... 04/ 03.07.2025: Heard, learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending her arrest for offences under Sections 115/85/109/61 (1)/ 127(1) of B.N.S. Act and Section 3/4 of Dowry Prohibition Act. 3. Petitioner is the mother-in-law. It is alleged that in-laws including this petitioner tortured and assaulted the wife. 4. During course of argument, it has been brought to the notice of this Court by the parties that the husband has been exonerated as the final report has been submitted in his favour. 5. The learned APP and informant oppose the prayer for anticipatory bail. 6. After hearing the parties and going through the F.I.R, I find that there is general allegation against this lady and there is no specific overt act alleged. Since the husband has already been exonerated during investigation, I feel that this is a fit case for grant of anticipatory bail to the petitioner. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Birni P.S. Case No.29 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 8. The petitioner should cooperate and join investigation and appear before the Investigating Officer once in 15 days. (ANANDA SEN, J.) R.S./
