Neutral Citation No. - 2025:AHC-LKO:1959-DB Court No. - 2 Case :- WRIT - C No. - 11249 of 2024 Petitioner :- Gaya Prasad Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Lko. And 4 Others Counsel for Petitioner :- Praveen Tripathi,Mukesh Kumar Sharma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Vakalatnama filed by Shri Kusum Tiwari, Advocate on behalf of the opposite party no. 4 is taken on record. Heard. The petitioner alleges interference by the local Police in a private dispute between the petitioner and opposite party no. 5, in spite of an interim order dated 21.02.2024 passed by the Board of Revenue. Learned Standing Counsel says that the local Police is not interfering in the dispute at all. As far as, interference by Police is concerned, we make it clear that the Police has no role to play in a private dispute between the parties unless and until, a crime is apprehended of being committed or is actually committed or there are other grounds in any statute or law warranting their interference including an
order of any Court if it is being violated. The local Police is therefore directed to abide by the observations / directions contained hereinabove. As far as, the private parties are concerned, they can get their dispute resolved in the appropriate forum as prescribed in law. We have not at all entered into the merits of the dispute between the private parties which is pending adjudication before the Board of Revenue. The writ petition is disposed of in the aforesaid terms.
