This Court vide order dated 08.12.2025 directed State counsel to seek instructions that as to why the application moved by the petitioner for demarcation has not been decided so far. 4. Today, learned counsel for the State placed before this Court instructions dated 15.12.2025, which are taken on record. 5. Learned counsel for the State, on the strength of the said instructions, submitted that Original Suit No. 88 of 2022, Pan Singh vs. Moti Singh and others, was decided ex parte against the petitioner, who was the defendant in the said suit, whereby an ex parte order of permanent injunction was granted. 6. In view of the aforesaid, a direction to the learned Assistant Collector/Sub-Divisional Magistrate, Nainital, to decide the demarcation application moved by the petitioner dated 04.09.2024 cannot be issued at this stage. 7.
