Bordoloi, learned Legal Aid Counsel for the applicant, who submits that the delay of 3104 days in filing the appeal against the conviction under Section 302 of the IPC should be condoned. Counsel for the applicant submits that the applicant has been in jail since the year 2016 after his conviction and due to his poverty, he could not prefer the appeal. She accordingly submits that the delay may be condoned as the same is unintentional. Ms. A. Begum, learned Addl. Public Prosecutor, Assam has got no objection to the delay being condoned. In view of the stand taken by the learned Addl. P.P., the delay of 3104 days is condoned. Registry to register the connected appeal and list the same after a week. I.A. is accordingly disposed off.
