Food And Civil Supplies Govt. Lko And 4 Others Counsel for Petitioner :- Rajesh Kumar Shukla Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Pankaj Bhatia,J. 1. Present petition has been filed by the petitioner alleging that the petitioner is running a fair price shop in terms of the allotment in his favour for the last 38 years at Village Panchayat Ashokpur, however, now the respondents have taken a decision to establish a shop at a separate place over Gata No.1093 which is recorded as Rasta in the revenue records, which is very inconvenient and the grains stored are likely to get spoiled on account of the same being adjacent to pond. 2. It is stated that a grievance has been raised by the petitioner. 3. Considering the fact that the petitioner is the fair price shop license holder, he has no vested right in running a shop from a particular place. The State Government is duly empowered to take any action for establishing or re-establishing the place of distribution as per public convenience. No right of the petitioner is adversely affected on account of the policy decision by the State Government warranting interference under Art. 226 of the Constitution. 4. Present petition stands dismissed in above terms. Order Date :- 20.1.2025 nishant Digitally signed by :- NISHANT MOHAN High Court of Judicature at Allahabad, Lucknow Bench
