1. Heard Mr. A. A. R. Karim, learned counsel appearing for the accused petitioner as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the

The instant bail application under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Hafizur Rahman Mondal, who is stated to be in under trial detention since 04.07.2025 praying for grant of bail in connection with Gossaigaon P.S. Case No.89/2025 under Sections 103/3(5) of BNS corresponding to GR No. 97/2025. 3. The case arose out of an FIR dated 01.07.2025 lodged by the father of the deceased who was stated to be married with the present accused. Their allegation is that she faced various torture and cruelty and on 08.06.2025 when the informant went to her matrimonial home the accused person named in the FIR has assaulted her causing injuries and also fed her poison forcefully. That, despite treatment over the next few days she stated to have expired on 28.06.2025. It is stated that she left behind one dying declaration. 4. Learned counsel for the petitioner submits that in the instant case both the wife and the present accused had consumed poison and he is undergoing treatment though he is in custody. 5. On the basis of the case diary which is received, learned Additional Public Prosecutor submits that the investigation is not yet completed and the materials collected so far reveals implication against the present accused and he made strong objection to his grant of bail. 6. I have perused the relevant portion of the case diary and the said dying declaration which was sent for forensic examination and prima facie returned a finding of handwriting match with the sample hand writing. 7.
Despite the progress of investigation and length of detention and considering the serious nature of allegation, I am of the considered view that investigation
