Neutral Citation No. - 2025:AHC-LKO:1248 Court No. - 8 Case :- WRIT - C No. - 11278 of 2024 Petitioner :- Mohd. Qayyum Respondent :- District Magistrate Distt. Sultanpur And 2 Others Counsel for Petitioner :- Rakesh Kumar Nayak Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for petitioner. Notice on behalf of respondent nos.1 and 2 has been accepted by the ofÏce of the Chief Standing Counsel. By means of the instant writ petition, the petitioner prays for the following relief for the ease of reference :- "ii). Issue a writ, order or direction in the nature of mandamus directing the opposite party no.3 to decide application dated 24.10.2024 moved by the petitioner U/S 67-A (2) of the U.P. Revenue Code, 2006, contained as Annexure No.3 to this writ petition." Having considered the aforesaid facts and noticing the fact that as per the case of petitioner, he has already moved an application on 24.102.2024 attempting to get the benefit of Section 67-A (2) of the U.P. Revenue Code, 2006, this Court is of the opinion that the first relief in the nature of mandamus granting the benefit to the petitioner, cannot be granted by this Court. So far as second relief is concerned, the petitioner has alternate remedy of approaching the Board of Revenue by way of filing an appeal in terms of Chapter 15 Rule 494 of the U.P. Revenue Code Rules, 2016. For the aforesaid reasons, this Court is not inclined to entertain the present writ petition. Accordingly, this writ petition is dismissed leaving it open to the petitioner to take appropriate legal recourse as may be available under the law.
