Present applicant Sharifa Baigum, W/ o Ali Haider resident of Karim Ganj District Isabil (Assam) is praying for bail in relation to FIR dated 20.02.2024, bearing FIR No. 0067 of 2024 at P.S. Haldwani, District Nainital, wherein the applicant has been implicated for the offence punishable under Section 370 of IPC read with Section 3, 4, 5 and 6 of Immoral Traffic (Prevention) Act, 1956. 4. Learned counsel for the applicant argued that the applicant is languishing in jail since 20.02.2024 and the trial has already been commenced and two other accused who are named in the FIR namely Faizal Khan and Saklain Sheikh have already been enlarged on bail by the trial court. He further submits that there is are total 11 prosecution witnesses out of which only 2 witnesses have been examined. 5. On the other side, Mr. Sandeep Sharma, learned AGA for the State have not disputed this fact that the two co- accused named above have already been enlarged on bail by the trial court. 6. After hearing the arguments of the learned counsel for the parties and taking into consideration that the two other co- accused have already been enlarged on bail and the trial has already been commenced and applicant is languishing in jail since 20.02.2024, this Court is of the view that the present applicant deserves 2025:UHC:10649 for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant “Sharifa Baigum” be released on bail on her executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
