Court No. - 2 Case :- WRIT - C No. - 11255 of 2024 Petitioner :- Vinay Kumar And 3 Others Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko And 4 Others Counsel for Petitioner :- Ashutosh Kumar Singh,Hari Om Pandey,Narendra Kumar Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J.
1. Heard learned counsel for the petitioners and learned Additional Chief Standing Counsel for the State.
2. The petitioners' counsel accepts that the land of the petitioners has not been compulsorily acquired nor has it been purchased by execution and registration of sale deed.
3. We, therefore, see no reason to consider the relief claimed in this writ petition at this stage. If the petitioners want to sell the land at a higher rate they may do so. If they do not want to sell the land on the rate offered by the opposite parties, nobody can compel them.
4. As of now, their land has not been compulsorily acquired as stated by the learned counsel for the State, therefore, there is no reason for the petitioners to come to the Court at this stage.
5. Accordingly, the writ petition is dismissed as not maintainable at this stage. . (Brij Raj Singh,J.) (Rajan Roy,J.) Order Date :- 7.1.2025 R.K.P. Digitally signed by :- RAJ KUMAR PATEL High Court of Judicature at Allahabad, Lucknow Bench
