1. By way of this petition, the petitioner has sought the following relief(s):-
“10.1 That this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of petitioner. 10.2 The Hon’ble Court may kindly be pleased to direct the respondent authorities, particularly the respondent no. 1 and 2 to granted the benefit of Time Scale Pay in view of the notification dated 28.04.2008 and 10.08.2009 (Annexure P-4) 10.3 That this Hon’ble Court may kindly be pleased to direct the respondent authorities to decide the pending SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2025.06.23 10:52:50 +0530
2 representations preferred by the petitioner as (Annexure P-5) strictly and accordance with the law and provision as applicable to the service rules or the regulations. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem fit. 10.5 Cost of the petition may also be given.”
2. Learned counsel for the petitioner would submit that the petitioner was initially appointed to the post of Chowkidar under the respondents vide
order dated 03.04.1984. He was promoted to the post of Lower Division Clerk on 10.01.1994, to the post of A.G. II on 21.07.2000 and to the post of A.G. I on 01.04.2010. He got retired from services in the year 2020. He would further submit that the petitioner was entitled to get time pay scale in view of the notifications dated 28.04.2008 and 10.08.2009, issued by the State of Chhattisgarh. He would also submit that the claim of the petitioner has not been considered yet.
3. On the other hand, learned counsel appearing for the State would oppose.

Taking into consideration the limited prayer made by Mr. Thomas, at this juncture, the instant petition is disposed of reserving liberty in favour of the petitioner to make a representation before the respondent authorities claiming therein time pay scale in light of the notifications dated 28.04.2008 and 10.08.2009, and in turn, the concerned authorities are directed to decide the representation strictly in accordance with the law, preferably within a period of 120 days from the date of receipt of a copy of this order.
6. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of. Sd/-
