Neutral Citation No. - 2025:AHC:19908 Court No. - 7 Case :- WRIT - A No. - 1684 of 2025 Petitioner :- Archana Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anil Kumar Pandey,Prabhakar Awasthi Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J. 1. Heard learned counsel for the petitioner and perused the record. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The basic relief sought by the petitioner in the present petition is to direct the Assistant Director of Education (Basic), Azamgarh, Region Azamgarh/respondent no. 2 to forthwith take into consideration the representation of the petitioner dated 25.10.2024 and pass order therein after giving fullest opportunity of hearing so that payment of salary be made to the petitioner on the post of clerk. 4. It is argued that the claim for payment of salary has been rejected by the District Basic Education Officer, Mau vide order dated 30th September, 2024. Aggrieved against the aforesaid the petitioner has submitted a representation before the Respondent No. 2/Assistant Director of Education (Basic), Azamgarh, Region Azamgarh. It is further argued that the aforesaid representation was filed pursuant to the circular/Government Order dated 3rd December, 1985, copy of which is appended as Annexure No. 11 to the affidavit filed in support of writ petition. Though considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, the present petition is disposed of directing the Respondent No. 2/Assistant Director of Education (Basic), Azamgarh, Region Azamgarh to decide the aforesaid representation strictly in accordance with law most expeditiously and preferably within a period of six weeks from the date of production of certified copy of this order unless there is no legal impediment.
