Court No. - 11 Case :- CRIMINAL MISC. WRIT PETITION No. - 10068 of 2024 Petitioner :- Ramesh Kumar Yadav And 2 Others Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another Counsel for Petitioner :- Balak Ram Counsel for Respondent :- G.A. Hon'ble Rajnish Kumar,J. Heard Shri Balak Ram, learned counsel for the petitioners and learned A.G.A. This Court had passed the following order on 03.01.2021:- "1. Having heard learned counsel for the petitioner, let this case be listed on 27.01.2025 on the question of maintainability of prayer no.1 of the petition. 2. Issue notice to opposite party no.2 returnable till the next date of listing. 3. Steps in this regard may be taken within three working days from today. 4. The pendency of this case shall not construe as any stay of proceeding pending before the trial court." Learned A.G.A. submits that this petition is misconceived. Even otherwise the application moved by the applicants before the concerned is also misconceived because the application under Section 321 Cr.P.C. could not have been moved by the accused/petitioners. Learned counsel for the petitioners submits that the petition may be dismissed as not pressed. To which there is no objection by other side. In view of above, the petition is dismissed as not pressed.
