6/11.08.2025 Heard learned counsel appearing on behalf of the Petitioner and learned Spl. P.P. appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Namkum (Kharsidag O.P.) P.S. Case No.106 of 2025, for the alleged offences registered under Sections 317(5)/3(5)/338/336(3)/340(2) of BNS and Section 4(1)A /21 of the Mines and Minerals (Development and Regulation) Act and Sections 7/9/13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation & Storage) Rules 2017, pending in the Court of learned Judicial Magistrate, 1st Class, Ranchi.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the owner of the truck and the allegations are made that 35 tons of coal was being transported on the truck and it is further alleged that the document was not found genuine.
4. It is submitted that the petitioner is not having any criminal antecedent as disclosed in paragraph No.7 of the petition.

Learned counsel for the State opposed the prayer and submits that the allegation of illegally carrying the coal on the truck is there.
6. Considering the fact that the petitioner is the owner of the truck and he has got no any criminal antecedent, I am inclined to grant him anticipatory bail.

Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi, in connection with Namkum (Kharsidag O.P.) P.S. Case No.106 of 2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023.
8. This Anticipatory Bail Application is accordingly allowed and
disposed of.
