The petitioners and respondent No.2 have filed the compromise petition under Section 320 read with Section 482 of Cr.PC along with the joint affidavit which reads as under: "WE, 1) Smt. K. Mahalakshmi, W/o Late K.S. Prakash, Aged about 62 years Smt. Madhuri K., W/o Karibandi Seetaramayya, aged about 42 years, both are R/at. No.688, 10th A Main, Jayanagar, 4th Block, Bengaluru South, Bengaluru - 560 011 2) Smt. R.D.M. Priyadarshini, W/o. Krishna Kishore Kalluri, - 3 - NC: 2025:KHC:1074 CRL.P No. 2147 of 2022 Aged about 38 years, R/a. Door No. 50, C Street Fort, Near Vani Vilas Hospital, Bengaluru- 560002, do hereby solemnly affirm and state as follows: 1. We are the petitioner and respondent No. 2 (Defacto Complainant) in the above petition. We know the facts of the case. 2. We state that the respondent No.2 has lodged a complaint dated 06.12.2021 before the respondent No.1 police which came to be registered as Crime No.243/2021 pending on the file of 37th ACMM At Bangalore by the respondent No.1, for the offences punishable under sections 354(D), 506, 120B and 34 of IPC against the petitioners and husband of respondent N o.2. Petitioners are mother in law and sister in law of the 2nd respondent. 3. We state that subsequent to filling of said complaint the 2nd respondent filed MC No. 2156/2022 for divorce against her husband before the 1st Additional Family Court At Bangalore. The petitioners, husband of 2nd respondent and 2nd respondent at the intervention of well-wishers and family members, 2nd respondent and her husband filed joint memo before the family court and reunite the family and agreed to withdraw all the pending cases each others as per the terms mentioned in the joint memo. The copy of the joint memo filed before - 4 - NC: 2025:KHC:1074 CRL.P No. 2147 of 2022 family court in MC No. 2156/2022 is enclosed along with this application. 4. We state that there has been a lot of changes in the circumstances from the date on which the complaint was filed to this day and the circumstances now warrant that the respondent No. 2 and her husband and the 2nd respondent lead a happy married life with the permission of this hon'ble court. 5. We state that there is no coercion or compulsion on 2nd respondent to compound the offences and on her own free will agreed to compound the case. Hence this application seeking kind permission of this hon'ble court to compound the offences. Wherefore, this hon'ble court be pleased to allow the accompanying application in the interest of justice. What is stated above all are true and correct to the best of our knowledge, belief and information." 3. The petitioners and respondent No.2 who have sworn to the affidavit admit the contents of the same. Respondent No.2 specifically stated that, she has withdrawn the allegations and the complaint made against the petitioners and she has no objection to allow the petition. It is also stated - 5 - NC: 2025:KHC:1074 CRL.P No. 2147 of 2022 that the husband and wife are re-united at the instance of well- wishers. Under such circumstances, respondent No.2 is withdrawing the complaint. 4. Submission is placed on record. Satisfied with the terms of compromise petition. The parties are permitted to compound the offences. 5. Accordingly, I proceed to pass the following: ORDER (i) The petition is allowed. (ii) The FIR registered in Crime No.243/2021 of Basavangudi Women Police Station, pending on the file of the learned 37th Additional Chief Metropolitan Magistrate Court, Bengaluru City, for the offence punishable under Sections 354(D), 506, 34 and 120B of Indian Penal Code, is hereby quashed.
