The land, in fact, has been acquired by the Public Works Department (National Highway Wing) of the State of U.P., therefore, the opposite party no. 1 has incorrectly been arrayed in the writ petition. 4. We have perused the document annexed as Annexure- 5. The petition has been filed under misconception of facts as noticed hereinabove. 5. The petition is dismissed with liberty to the petitioner to file a fresh petition, if there is a cause.
