For Respondent(s) : Mr. Jitendra Singh Rathore, Addl. GA HON'BLE MR. JUSTICE MANEESH SHARMA (V. J.) Order 17/06/2025 1. The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of the petitioner, who has been arrested in connection with FIR No.224/2025 registered at Police Station Bassi (Jaipur City East) District Jaipur City (East) for the offences punishable under Sections 281, 109(1), 121(1), 331(1) of the Bharatiya Nyaya Sanhita, 2023 and Section 3 of the Prevention of Damage to Public Property, 1984. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is in judicial custody since 01.04.2025. Learned counsel for the petitioner submits that after completion of investigation, charge-sheet has been filed and the offences are triable by Magistrate; the trial of the case will take considerable time to conclude, therefore, further [2025:RJ-JP:23310] (2 of 2) [CRLMB-5640/2025] custody of the petitioner would not serve any fruitful purpose, so, the petitioner may be released on bail. 3. Learned Additional Government Advocate has opposed the submissions made by the learned counsel for the petitioner. 4. Heard learned counsel for both the parties and perused the material available on record. 5. Considering the fact that petitioner is in judicial custody since 01.04.2025 and after completion of investigation, charge- sheet has been filed and the fact that the trial of the case may take considerable time, thus, without commenting any opinion on the merits/demerits of the case, this Court deems it just and proper to allow this bail application. 6. Accordingly, the bail application under Section 483 Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and it is ordered that the accused/petitioner Manish Khatri S/o Shri Prakash Khatri shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
