Mr. Ajoy Pebam, learned counsel appearing for the petitioner submitted that the petitioner may be allowed to withdraw the present writ petition with liberty to approach the appropriate forum by filing an appropriate petition/application. The learned counsel further prays that the petitioner may be granted 10(ten) days time to file such petition/application and in order to protect the interest of the petitioner and to avoid rendering the application infructuous, a protection may be given by this Court by passing an appropriate order. The learned counsel submits that the petitioner will file such application within 10(ten) days and a direction be issued to the respondents not to release the pension and other retiral benefits due payable to the LRs of the deceased government employee during the said ten days. [2] Mr. Th. Vashum, learned GA appeared for the State respondents and Mr. S. Suresh, learned counsel appeared for Accountant General and Mr. K. should be limited during the period of ten days and that a clarification be issued that such interim order has been passed without considering the merit of the case. [3] In view of the submission made above by the learned counsel appearing for the parties, the petitioner is allowed to withdraw the present writ petition with liberty as sought for. It is made clear that the petitioner should file any appropriate petition/application before the appropriate forum within ten days from today and during the said ten days, the respondents are directed not to release the pensionary and other retiral benefits due payable to the LRs of the deceased government employee. It is, further made clear that such interim order has been passed without considering the merit of the present writ petition and in order to safeguard the interest of the petitioner.
It is left open to the appropriate forum to consider for passing any interim order as deem fit and proper after considering the merit of the case. [4] It is, further, made clear that if the petitioner did not file any such application/petition within 10(ten) days, the official respondents are liberty to release the aforesaid pensionary and other retiral benefits due payable to the LRs of the deceased government employee.
