Neutral Citation No. - 2025:AHC-LKO:851 Court No. - 8 Case :- WRIT - B No. - 1320 of 2024 Petitioner :- Abdul Moid Respondent :- Chairman Board Of Revenue Lko And 7 Others Counsel for Petitioner :- Udai Pratap Lal Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos.1, 2 and 3 has been accepted by the office of Chief Standing counsel. Under challenge is the order dated 25.11.2024 passed by the respondent no.1 whereby after hearing the parties concerned, the Court had fixed the next date as 26.12.2024. Submission of learned counsel for the petitioner is that he has been deprived of an opportunity of hearing. It is urged that the petitioner was appearing on caveat before the respondent no.1 and when the matter was taken up on 25.11.2024, the revision was admitted, the records of the trial court was called for and the other respondents in the revision were issued notice fixing 26.12.2024. It is also urged that an attempt is being made to usurp the property of the petitioner and no adequate property has been granted to the petitioner. Having considered the aforesaid submissions and from a perusal of the material on record, it appears that after hearing the petitioner and the revisionist before the respondent no.1, the order dated 25.11.2024 was passed fixing 26.12.2024. There is nothing on record to indicate as to what transpire on the next date. Moreover, the petition has been filed on 16.12.2024 and when the matter was taken up today, it has not been indicated as to what is the next dated fixed and what transpire in the intervening period. Be that as it may, since the order dated 25.11.2024 is interlocutory in nature, in as much as, the revision has been admitted, no rights of the parties has been finally decided, this Court is of the opinion that the petition against such order is not maintainable and is, accordingly, dismissed. It is made clear that mere dismissal of the aforesaid petition may not be construed as an opinion on merit and it shall be open for the petitioner to raise his all grievances before the court concerned which needless to say shall be heard and considered by the Court concerned in accordance with law.
