The present petition has been filed with the following prayers: "a) suitable Writ, Order or Direction in the nature of certiorari quashing the impugned order passed by opposite party no. 3 after summoning the same from opposite party no. 3. b) suitable Writ, Order or Direction in the nature of mandamus directing the Opposite Parties from carrying out restrain encroachment of public path way in over plot No. 322 situated in Village Chandapur, pargana Sadar, Tehsil Lalganj, District Pratapgarh." 3. The document on record reveals that the petitioner has also filed a suit, which is pending before the Civil Judge (S.D.), Pratapgarh. 4. Considering that the said suit is pending, no relief can be granted by this Court. The petitioner would be at liberty to avail his remedy in accordance with law. 5. The petition stands disposed of.
