Neutral Citation No. - 2025:AHC:28748 Court No. - 79 Case :- HABEAS CORPUS WRIT PETITION No. - 249 of 2023 Petitioner :- Ansh Dubey And 3 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ajay Shukla,Lalit Singh Tomar,Ram Chandra Tripathi Counsel for Respondent :- A.C.Tiwari(Ac),Akshaya Kumar,Anshuman Jha,Chanda Chaubey,G.A.,Pankaj Dubey,Shriman Narayan Tiwari Hon'ble Saurabh Srivastava,J.
1. Heard learned counsel for petitioners and learned AGA for the state respondents.
2. The present petition has been filed in the nature of Habeas Corpus Petition directing the respondent no. 5 to release petitioner nos.1 to 3 (detenues) from his illegal detention.
3. There is hardly any discussion regarding illegal detention as carried out by respondent no.5. So far as regarding compliance of the coordinate bench order dated 19.9.2024 is concerned, specific instructions have been received by learned AGA, which shows that
order has already been complied with and it is the petitioner no.4 who had been provided vegetation rights as per the orders of this court but she is misusing the vegetation rights by way of settling the property issue with her father-in-law which is not at all permissible at the behest of the vegetation rights available to a mother for maintaining her children only.
4. In view of the aforementioned facts and circumstances, the petition lacks merits and is hereby dismissed.
