This appeal has been preferred by the appellants assailing the impugned order dated 18.11.2025 passed by learned Civil Judge (Senior Division), Vikasnagar, Dehradun in Original Suit No. 139 of 2025, Smt. Radha Vs. Mohd. Usman and Others. By the said order, the learned trial court granted an ex parte injunction in favour of respondent no.1 and directed both parties to maintain status quo over the land in dispute, holding that a prima facie case appeared to be made out in favour of respondent no.1. 4. During the course of arguments, learned counsel for the parties jointly submitted that the present appeal may be disposed of in view of the undertaking furnished by them that neither party shall seek any adjournment on the next date of hearing before the learned trial court. It 2025:UHC:11051 was further prayed that the learned trial court be directed to decide Application 6C on merits within a time frame to be stipulated by this Court. 5. In view of the statements made and the undertaking furnished by the parties, the Appeal from Order stands disposed of. The learned trial court is required to decide Application 6C filed in Original Suit No.139 of 2025, Smt. Radha Vs. Mohd. Usman and Others, expeditiously and strictly in accordance with law, after affording due opportunity of hearing to both the parties. The parties shall adhere to their undertaking and shall not seek unnecessary adjournments.
