(2) According to petitioner, his younger brother managed to get compassionate appointment after death of their father by forging petitioner’s signature on an affidavit, wherein petitioner’s no objection was given. (3) Learned State Counsel, however, has drawn attention of this Court to the affidavit given by petitioner’s mother, in which she has stated that petitioner is living separately for the last more than seven years and further that since petitioner is not taking any responsibility towards his family, therefore he should not be given compassionate appointment and instead, his younger brother Narendra Singh Tomar be appointed on compassionate ground in place of his father. (4) The relief as prayed by the petitioner cannot be granted, as respondent no. 3 is the younger brother of the petitioner, therefore he is also entitled for compassionate appointment. (5) Without going into the merits of the case, writ petition is disposed of by permitting the petitioner to make a representation. If he makes representation, the same shall be considered and decided as per law.
