JUSTICE A. GUNESHWAR SHARMA O R D E R 18-02-2025 [1] Heard Mr. N. Jotendro, learned senior counsel assisted by Md. Syed Murtaza Ahmed, learned counsel for the petitioner and Mr. Niranjan Sanasam, learned Government Advocate for the State respondents appearing through video conferencing. [2] The petitioner approaches this Court for restoration of armed escort which was withdrawn by the impugned order dated 19-09-2023 issued by the Director General of Police, Manipur. It is stated that the petitioner, who is a political activist as well as the Managing Director of a private firm, has been receiving threats from the militant organization demanding ransom. In this regard, it is submitted that the earlier armed guards may be restored by setting aside the impugned order dated 19-09-2023. [3] Mr. N. Jotendro, learned senior counsel for the petitioner also draws the attention of this Court to the contents of the counter affidavit filed by respondent No. 3 in para No. 3 that there was a threat perception to the petitioner in the year 2022. NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.02.19 16:19:56 +05'30' WP(C) No. 686 of 2023 [4] During the pendency of the writ petition, in terms of the subsequent event of another threat from a militant organization in the year 2024, the petitioner submitted another representation dated 06-05-2024 to the Commissioner (Home), Government of Manipur for reviewing the impugned order dated 19-09-2023 to restore arms and ammunitions to the security personnel provided to him. [5] At this stage, Mr. Niranjan Sanasam, learned Government Advocate of the State respondents, submits that the writ petition may be disposed of by directing the respondents specially, Commissioner (Home), Government of Manipur to dispose of the subsequent representation dated 06-05-2024 by a speaking order. [6] However, Mr. N. Jotendro, learned senior counsel for the petitioner, submits that it will suffice for the petitioner, if the representation is disposed of in terms of the threat perception contained in para 3 of the counter affidavit filed by respondent No. 3. [7] Recording the submissions made at the Bar, the writ petition is disposed of by directing the respondents to consider the subsequent representation dated 06-05-2024 submitted by the petitioner to the Commissioner (Home), Government of Manipur by a speaking order in terms of the material on record within a period of one month from the date of receipt of a copy of this order. [8] It is made clear that this Court does not express any opinion on the merit of the case. [9] Furnish a copy of this order to the learned counsel appearing for the parties. JUDGE Victoria
