Neutral Citation No. - 2025:AHC-LKO:296 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 6423 of 2024 Petitioner :- Wasifa Khatoon And 3 Others Respondent :- Board Of Revenue, U.P. Lko. Thru. Its Member And 4 Others Counsel for Petitioner :- Diwakar Nath Tiwari,Umaker Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Jaspreet Singh,J.
1. Heard learned counsel for the petitioners. Notice on behalf of respondent No.1 has been accepted by the office of Chief Standing Counsel. Shri Mohan Singh, learned counsel has accepted notice on behalf of respondent No.5.
2. The submission of learned counsel for the petitioners is that a revision was filed by the petitioners before respondent No.1. The said revision was admitted by respondent No.1 by means of the order dated 25.11.2024. However, for considering the application for interim relief, respondent No.1 fixed 11.03.2025 as the next date. He further urged that the petitioners have moved an application for early hearing on 11.12.2024, upon which no effective order has been passed. As a result, though the revision of the petitioners has been admitted, but his application for interim relief has been deferred for a long date in the month of March, 2025 and in the meantime, the petitioners are suffering hardship.
3. Considering the fact and circumstances of the case, this Court is of the view that no gainful purpose would be served in keeping the petition pending. Accordingly, notice to private respondent Nos.2 to 4 is dispensed with.
4. This Court further finds that ends of justice can be met by directing respondent No.1 to consider the pending application for interim relief after affording opportunity of hearing to the parties, but without granting any unnecessary adjournment and for the aforesaid purpose, in case if the petitioner moves an application for early hearing, respondent No.1 shall pass appropriate orders thereon so that the application for interim relief is decided as expeditiously as possible.
5. With the aforesaid, the petition is disposed of.
6. It is made clear that the Court has not examined the plea of either of the parties on merit and the court concerned shall decide the matter in accordance with law. Order Date :- 3.1.2025/Ashutosh Digitally signed by :- ASHUTOSH PANDEY High Court of Judicature at Allahabad, Lucknow Bench
