PUBLIC PROSECUTOR The Court made the following Order: ...RESPONDENT/COMPLAINANT The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioner herein/A3 to grant anticipatory bail in connection with Crime No.09 of 2025 of RSASTF Police Station, Tirupati District. A case has been registered against the petitioner and others for the offences punishable under Sections 303 (2) read with 3(5) of the BNS, 49, 61(2) of the BNS and Section 20(i)(d)(i)(a) read with 20(i)(c) ii, iii, iv, x, 36(a) read with 32A of the A.P. Forest Amendment Act, 2016.
Brief facts of the case are that, on 17.02.2025, on receipt of credible information, the RSI, RSASTF Sub-Control, Kadapa, along with his staff rushed to Jamoil Plantation, Bhakarapet Forest Beat and Section, Siddavattam Mandalam, and noticed one motor cycle stationed and some persons standing by the side of motor cycle. On seeing the police party, they tried to escape by leaving the

2 motor cycle. The RSI with the assistance of his staff apprehended one person and found 27 Red Sander logs. The contraband along with other material was seized under the cover of special report. Heard. Perused the record.
Learned counsel for the petitioner submits that basing on the confessional statement co-accused, the petitioner herein is arrayed as accused. Except the said confessional statement, no other material has been collected to connect the petitioner in commission of offence. Learned Assistant Public Prosecutor has also not disputed the correctness of the said submission of learned counsel for the petitioner. Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner herein and submitted that the petitioner herein has no previous crime record. In view of the
facts and circumstances of the case and considering the fact that no property was seized from the possession of the petitioner herein and most of the witnesses are shown to be official witnesses and granting of anticipatory bail to the petitioner would not cause hampering of investigation, this Court is inclined to grant anticipatory bail to the petitioner herein, on the following conditions, (i) The petitioner is directed to surrender before the Station House Officer concerned, within a period of two (2) weeks from the date of receipt of a copy of this order. On such surrender, the petitioner herein is ordered to be enlarged on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum to the satisfaction of the Station House Officer concerned.

3 (ii) On release, the petitioner shall appear before the Station House Officer, concerned, once in a fortnight, for a period of three (3) months, (iii) The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous applications pending, if any, in this Criminal Petition shall stand closed
