The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“….to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioners for the post of Khalasi is illegal, arbitrary and contrary to the principals of natural justice and consequently seeking a direction to the Respondents to appoint the petitioners as Khalasi...”
2. Heard Mr V.Raghu, learned counsel for the petitioner and Mr Kiran Kumar Vadlamudi, learned Standing Counsel appearing for Respondent No.1.
3. On hearing, Mr Kiran Kumar Vadlamudi, learned Standing Counsel appearing for Respondent No.1 submits that the present Writ Petition is filed seeking to consider the case of the petitioner for the post of Khalasi and to that effect, the petitioner has submitted several representations to the respondents. As the petitioner did not qualify the physical test and interview, his representations were rejected on 10.05.2010 i.e., before filing of the Writ Petition and the rejection order was also served on the petitioner.
4. Considering the submissions of the learned Standing Counsel for Respondent No.1, as the representations of the petitioners were rejected on 10.05.2010, petitioner is given liberty to challenge the rejection order, dated 10.05.2010 in separate proceedings if he has any further grievance.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
