Neutral Citation No. - 2025:AHC-LKO:158 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 6321 of 2024 Petitioner :- Om Prakash Tiwari Respondent :- Board Of Revenue,Thru Chairman Board Of Revenue U.P. Lucknow And Others Counsel for Petitioner :- Om Prakash Yadav,Tulsi Ram Yadav Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of the respondent No.1 has been accepted by the office of the Chief Standing Counsel. At the outset, it may be noticed that the first petition filed by the petitioner bearing Writ Petition No.4944 of 2024 (A-227) was dismissed by this Court vide order dated 21.10.2024 granting liberty to file afresh with proper and complete parties. Despite the same, the instant petition has been filed seeking expeditious disposal of the application for impleadment. The record indicates that a revision is pending before the respondent No.1 filed by the private-respondent No.2 against the private-respondents No.3 and 4. It appears that the present petitioner along with five other persons had moved an application for impleadment, a copy of which has been brought on record as Annexure No.3. The said application though moved on behalf of six parties, but in the instant petition, they have not been impleaded as a party and the petition suffers from vice of non-joinder of the proper and necessary parties. Since, the earlier petition was also dismissed for want of proper and complete parties, the same mistake has been committed by the petitioner and for the said reasons, this Court is not inclined to entertain the petition, however, leaving it open for the petitioner to move an appropriate application before the Court concerned. With the aforesaid liberty, the petition is dismissed. Order Date :- 3.1.2025 Rakesh/- Digitally signed by :- RAKESH PRAJAPAT High Court of Judicature at Allahabad, Lucknow Bench
